Kaira: Math
These Terms of Use ("Terms") govern your use of the mobile application Kaira: Math ("the app"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, please do not use the app.
The app is published by Spartak Kagramanyan, a private individual based at Peter Martensstraat 41, 1087 NA Amsterdam, Netherlands ("the publisher", "we", "us").
If you are a parent or guardian setting up the app for a child, you accept these Terms on behalf of yourself and the child.
Kaira: Math is a mobile application that helps children aged 7 to 9 practice arithmetic (addition and subtraction). It includes a child-facing practice mode and a parent dashboard protected by a PIN.
The app is a learning aid. It is not a substitute for school instruction, professional tutoring, or formal educational assessment. We make no claims about specific learning outcomes for any individual child.
Kaira: Math is offered as an auto-renewing subscription with the following terms:
All purchases, payments, refunds, and subscription management are handled by Apple through the App Store. The publisher does not process payments and has no ability to issue refunds directly. Refund requests must be made through Apple at https://reportaproblem.apple.com.
Nothing in these Terms limits your statutory rights as a consumer under European Union or Dutch law, including any rights under the Dutch Civil Code (Burgerlijk Wetboek). Where these Terms conflict with non-waivable consumer protections, those protections apply.
Subject to these Terms and your active subscription (after the free trial), the publisher grants you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices that you own or control, in accordance with Apple's Usage Rules (which are part of the Apple Media Services Terms and Conditions).
You may not: copy, modify, reverse-engineer, decompile, distribute, sublicense, rent, lease, or sell the app or any part of it; remove copyright notices; or use the app for any unlawful purpose.
All content in the app — including the Kaira character illustrations, the user interface design, the curriculum structure, the text, and the underlying software — is owned by the publisher and protected by copyright and other intellectual property laws. The "Kaira: Math" name and the Kaira character are the property of the publisher.
The data created by your use of the app (child profiles, practice records, achievements) is yours and remains on your device.
You agree to use the app only for its intended purpose: practicing arithmetic. You agree not to use the app in any way that could harm the app, the publisher, or other users.
The app is provided "as is" and "as available", without warranties of any kind, except as required by applicable consumer protection law. The publisher does not warrant that the app will be uninterrupted, error-free, or suitable for any particular educational purpose.
The app is a tool to support learning. The publisher makes no representation that any specific child will improve their arithmetic skills, achieve any particular grade, or reach any specific level of proficiency through using the app.
To the maximum extent permitted by applicable law, the publisher's total liability for any claim arising out of or relating to the app is limited to the amount you have paid for the subscription in the twelve months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under Dutch or EU consumer law.
You may stop using the app at any time by uninstalling it. Your subscription will continue to renew until cancelled through Apple, regardless of whether the app is installed.
The publisher may terminate or suspend access to the app if you materially breach these Terms.
The publisher may update these Terms from time to time. The updated Terms will be published at the same URL with a new "Last updated" date. Your continued use of the app after Terms are updated constitutes acceptance of the new Terms. If you do not accept updated Terms, you should cancel your subscription and stop using the app.
You acknowledge that these Terms are between you and the publisher, not between you and Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app.
Apple is a third-party beneficiary of these Terms and has the right to enforce them against you. In the event of any failure of the app to conform to applicable warranty, you may notify Apple, and Apple may refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
You represent that you are not located in a country subject to a U.S. Government embargo and that you are not on any U.S. Government list of prohibited or restricted parties.
These Terms are governed by the laws of the Netherlands. Any dispute arising out of or relating to these Terms or the app shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, except where mandatory consumer protection law gives consumers the right to bring proceedings in their country of residence.
